These terms and conditions apply to users registering and making purchases with Mobill as of January 2015.
Confirmation at first purchase
To use the service, send an SMS containing the order code to a Mobill service number. By doing so you agree to these terms and conditions of purchase and agree to your personal data required for the service. When you make purchases through your mobile, a binding agreement is concluded between you and Mobill. Mobill reserves the right to refuse to make a purchase agreement if you act in violation of these terms and conditions.
The first purchase is invoiced to the person responsible for the mobile subscription, unless another payee or payment method has been registered at my.mobill.se
You will always receive an SMS or in-app message confirming your purchase.
Registration on our website
If you want to avoid the invoice fee by paying directly with your debit card, you can visit the website and register. Here you can also choose payment methods and which mobile numbers should be associated with the payment method you selected. You can choose to pay by invoice or bank / debit or credit card. The maximum amount you can purchase per month, regardless of payment method, is 1500 kr. You can easily change your details at any time when you are logged in.
Customer's responsibilities
You are responsible for any traffic charges to the mobile operator for data and sending/receiving SMS. You are responsible for ensuring that purchases made using your mobile are not abused. You are also responsible to ensure that your mobile phone can display the Mcode for validation.
Mobill's responsibilities
Mobill shall not be responsible for errors or delays that are a direct or indirect consequence of causes or circumstances beyond the immediate control of Mobill. Mobill makes no warranties that you can always use the service. However, Mobill shall try to resolve any errors in the service that Mobill is aware of.
By by invoice and credit-check
Mobill uses mobile phone number to identify the person who makes the purchase. The invoice is sent to the person respopnsible for the mobile subscription - or to the person and address stated at the time of registration. An Invoice with a list of purchases is sent monthly and there is a fee of 19 kr per invoice. Payment must be made within 10 days. If payment is not received, a reminder fee of 50.00 SEK plus late payment interest at 20% will be added. The claim can then be handed over for collection handling where additional collection costs may arise if payment is not made. At each purchase, a credit check is made, which in some cases means that credit information is taken. You will then receive a copy of the credit report by mail. The credit check can result in payment by invoice being declined. In this case, please set up an alternative payment method, such as a bank or credit card at my.mobill.se The age limit for payment by invoice is 18 years.
Pay by card (Visa/MasterCard)
Permitted cards for payment are VISA and Mastercard. When registering with a card, the card number, the valid until date and the CVC code are required. The age limit for payment by card is 18 years. There is no additional fee to use a card.
Returns policy
Always contact the place of purchase in the first case and check the situation with your purchase. Statutory right of withdrawal according to Distance Sales Regulations (distans- och hemförsäljningslagen) (2005: 59), does not apply to agreements that concern, for example: • Transport • Parking • Cultural events, sports events or the like • Food and other perishable goods Further information about refunds can be found on Mobill's website. Mobill shall not be responsible for indirect losses except where gross negligence is proven.
Misuse and blocking of the service
Mobill reserves the right, without prior notice, to block the Service, in whole or in part, in the event of suspicion of unauthorized use or abuse of the Service, or if, for technical, security or other reasons, Mobill considers that this should be done to protect the interests of Mobill, Clients, or other parties. Abuse shall include, all types of fraud, false purchases or false information. Cases of Abuse shall be reported to the police or prosecutor's office without exception. The service can also be blocked if you do not pay your invoices on time or if you exceed the limit for how much you can purchase per month.
Personal information at Mobill
By signing up with SMS or at my.mobill.se you are given the opportunity to purchase and pay with Mobill's service on your mobile. The requirement to register a customer profile is mandated by the Payment Services Act (Betaltjänstlagen) (2010: 751), which includes measures to prevent money laundering. Your personal information will be processed according to the provisions of the Personal Data Act (Personuppgiftslagen) (1998: 204) and other relevant laws. Personal data is processed in order for Mobill to fulfill its obligations to you regarding the service. Personal data may be disclosed to another authority if there is an obligation under law. You may at any time request that your data be deleted, changed or blocked if it appears to be incorrect or incomplete. To do this, submit a written and signed request to Mobill's customer service. Force Majeure
Mobill shall be excused from the obligation to fulfill its part of the agreement and from the obligation to pay damages for Mobill's commitments not at all or only at abnormally high costs can be accomplished due to war, riots, blockade, fire, explosion, or involvement of public authorities such as Mobill could not predict. Mobill is not liable for damage caused by law enforcement, government action, war event, strike, blockade, boycott, lockout or other similar circumstance. The condition regarding strike, blockade, boycott and lockout applies even if Mobill is subject to or undertakes such a conflict. Mobill is also not obliged to rectify any damage caused by Mobill in other cases. Mobill shall not be responsible for any indirect damage.
Changes and duration
Mobill has the right to change these terms and conditions without prior notice. The revised terms and conditions are binding if you continue to use the service after the changes have come into effect. The terms and conditions shall apply until further notice. You are entitled to terminate your agreement with Mobill with immediate effect at any time. The simplest way to do this is to deregister.
Applicable law and dispute resolution
Swedish law shall apply to these terms and conditions and related legal relationships. Disputes concerning the interpretation or application of these conditions and related legal relationships shall be settled by a general court.
